Terms of Service

1. Who we are

Jewelry Identifier (Jewelio) provides AI-assisted jewelry identification and estimated valuation tools for collectors, enthusiasts, and related use cases. The Services include the marketing website, free web identification (including /try and free tool pages), the public gallery, blog content, and the Jewelio iOS app on the App Store.

2. Eligibility

You must be old enough to form a binding contract in your jurisdiction and able to comply with these Terms. You may not use the Services if doing so would violate applicable law.

3. Free web identification and public gallery

We offer a limited number of free AI identifications on the website without signup (currently three successful identifications per visitor, subject to change). Free tries may be limited using technical measures such as hashed IP addresses and similar abuse controls.

Public gallery publication. When you use free identification on the web, the photo you upload and the identification result we generate may be published to our public gallery, which is available to anyone on the internet, may appear in search results, and may be retained by us for product, educational, demonstration, and marketing purposes. Do not upload anything you would not want shown publicly.

• You are solely responsible for the photos you upload and for having the rights to upload them.
• Do not upload images that include people, children, personal documents, private property you are not authorized to share, or illegal content.
• Free identification is provided "as available." We may refuse, rate-limit, or discontinue free access at any time.
• Non-jewelry images or failed requests may not count as a successful identification, at our discretion and based on system rules.

4. License you grant us

By uploading content to free web identification or otherwise submitting content to the Services, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, analyze, adapt, publish, display, distribute, and create derivative works from that content for operating the Services, including publishing free web identifications in the public gallery, improving our products, and related marketing and SEO.

You represent that you have all rights needed to grant this license and that your content does not infringe others' rights or violate law.

5. Not a professional appraisal

Identifications, authenticity hints, historical context, and value ranges are automated estimates generated from a photo (or limited inputs) using AI. They are for informational and entertainment purposes only. They are not a certified appraisal, authentication, grading report, insurance valuation, or professional gemological opinion.

Values can be wrong. Materials, stones, condition, provenance, and market prices cannot be fully determined from a single photo. For insurance, resale, estate, legal, or authentication decisions, consult a qualified jeweler, gemologist, or appraiser.

6. Acceptable use

You agree not to:

• Abuse free trials, bypass limits, or automate the Services without our written permission.
• Upload malware, unlawful content, or content that violates privacy or intellectual property rights.
• Scrape, bulk download, or republish the gallery or site in a way that harms the Services or violates these Terms, except as allowed by ordinary browser use or search indexing.
• Reverse engineer, disrupt, or attempt unauthorized access to the Services or related systems.
• Use the Services to provide competing commercial bulk identification without our agreement.
• Misrepresent AI outputs as certified professional opinions.

7. Mobile app and paid features

Some features may require downloading the Jewelio app from the App Store and may involve free trials, subscriptions, or in-app purchases managed by Apple. Billing, refunds, and cancellations for App Store purchases are handled under Apple's terms and policies unless we state otherwise. Availability of free web identification does not guarantee equivalent free access inside the app.

8. Intellectual property

The Services, including branding, software, design, blog content we publish, and AI output presentation, are owned by us or our licensors. Except for the limited rights needed to use the Services, no rights are granted to you. You retain ownership of your original photos, subject to the license in Section 4.

9. Third-party services

The Services rely on third parties such as AI model providers, hosting, storage, analytics, and the Apple App Store. We are not responsible for third-party services we do not control. Your use of those services may be subject to their terms.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT IDENTIFICATIONS OR VALUES WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY TRANSACTION OR LEGAL PURPOSE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICES OR RELIANCE ON ANY IDENTIFICATION OR VALUE ESTIMATE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

12. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Services, or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate access to the Services at any time, including for abuse of free identification, legal risk, or operational reasons. You may stop using the Services at any time. Provisions that by nature should survive (including licenses for already published gallery content, disclaimers, and liability limits) will survive termination.

14. Changes to the Services or Terms

We may change or discontinue features (including free try limits and gallery behavior) at any time. We may update these Terms by posting a new version with a revised date. Continued use after changes means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of Jewelry Identifier (Jewelio) is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in that jurisdiction will have exclusive venue, except where applicable law requires otherwise for consumers.
